1. Introduction

This Privacy notice explains how the data is collected, used, shared, and safeguarded when you use the NextGen.Ke Platform ("the Programme" , "the Platform" , "we" , "our" or "us").

1.1 Scope & Key Parties

This notice applies to all users of the NextGen.Ke Platform, including candidates, company representatives, and administrators. By using the Platform, you consent to the data practices described in this notice. For the purpose of data governance on this Platform:

UNDP (Data Controller)

As the Data Controller, UNDP hosts the platform and provides its infrastructure.

KEPSA (Programme Partner)

KEPSA acts as a Data Processor on behalf of UNDP for the purposes of company vetting, candidate dispatch, and report approval. KEPSA processes your personal data only as instructed by UNDP and solely for the operation of the NextGen.Ke Programme. KEPSA does not independently determine how your data is used.

Partner Companies

When your profile is shortlisted, relevant information necessary for placement consideration is shared with the matched Partner Company. Upon receiving your data, the Partner Company becomes an independent Data Controller for that data. However, before any data is shared, each Partner Company is required to agree to data protection obligations that include using your data solely for the purpose of evaluating your candidacy for the internship placement.

Important: This notice should be read together with our Terms of Use. Capitalized terms not defined here have the meaning given in the Terms.

2. Data We Collect

We collect information to provide, improve, and secure the NextGen.Ke Platform. The types of data we collect depend on how you interact with us.

2.1 Information You Provide

A. For Candidates (Youth)

  • Identity Data: Full name, date of birth, gender and national ID number for verification purposes.
  • Contact Data: Email address, phone number, county of residence.
  • Educational Data: Institution name, degree/diploma/certificate, field of study, graduation year.
  • Professional Data: Work experience, skills, certifications.
  • Disability Information: If voluntarily disclosed for accommodation purposes.
  • Documents: Academic transcripts, national ID copies, professional certifications.

B. For Partner Companies

  • Company Details: Registered company name, KRA PIN, and Industry sector.
  • Representative Data: Full name, official work email, and phone number of the primary contact person.
  • Placement Data: Specific Job Descriptions, required intern quotas, and physical office locations.

2.2 Information We Collect Automatically

When you use the Platform, we automatically collect technical data to ensure its functionality and security for all users:

  • Usage Data: Pages visited, features used, and time spent on Platform.
  • Device Data: IP address, browser type, and operating system.
  • Log & Audit Data: Access times, error logs, and a strict audit trail of actions taken by Company and Administrator accounts, such as viewing or downloading candidate data.

2.3 Sensitive Personal Data

We may collect sensitive data only with your explicit consent and used solely for the specific purposes disclosed in this notice.

  • For Candidates: This includes "sensitive personal data" such as your National ID number and any voluntarily disclosed disability status.

3. Legal Basis for Processing

We rely on the following legal bases for processing your personal data, and therefore this agreement is subject to UNDP’s Personal Data Protection and Privacy Policy (read the full Policy here)

✓ Consent

You consent to processing your data when you create an account and submit your application. You may withdraw consent at any time (subject to legal or contractual restrictions).

✓ Legitimate Interests

We process data where necessary to facilitate the core functions of the internship matching programme and ensure the security and integrity of the Platform.

4. How We Use Your Data

We use your personal data exclusively for purposes related to the NextGen.Ke Programme. We do not sell your data or use it for commercial marketing.

For Candidates

  • To verify identity and programme eligibility.
  • To evaluate and score your application profile.
  • To match your profile with relevant Partner Company job descriptions.
  • To send you status updates and platform notifications.

For Partner Companies

  • To verify your organization's legitimacy and legal standing.
  • To manage your intern placement quotas and job postings.
  • To facilitate applicant matching against your job descriptions.
  • To maintain a secure audit trail of recruiter access to shortlisted candidate profiles.

System-Wide Usage

  • To detect and prevent fraudulent activity on the Platform.
  • To monitor and improve overall Platform performance and stability.

4.1 Algorithmic Matching (Automated Processing)

We use automated algorithms to evaluate candidate profiles against the requirements of Partner Companies. This scoring is based strictly on the data provided by candidates (e.g., skills, education, experience).

While the system suggests matches, final shortlisting and hiring decisions are ultimately subject to human review by UNDP administrators and the respective Partner Companies.

5. Data Sharing & Disclosure

Your data is shared only for the explicit purpose of operating the NextGen.Ke Programme, as outlined below.

5.1 UNDP (Data Controller)

UNDP is the data controller for this platform.

5.2 KEPSA (Programme Partner)

As the designated Programme Partner, KEPSA is granted role-based access to specific platform datasets strictly to perform its mandated operational functions.

5.3 Partner Companies

When matched to a Partner Company, we share only necessary evaluation data such as candidate profile, documents, and motivation letter.

6. Data Retention

We retain your personal data only as long as necessary to fulfil the purposes outlined in this notice. Different retention periods apply depending on your relationship with the Programme:

Unsuccessful Applicants

If you are not selected for placement, your profile data is retained in the active matching pool for the duration of the current programme cycle to allow for future matching opportunities. If no placement is made, your data is securely deleted within 12 months of the programme cycle ending.

Placed Interns

Your data, including monthly reports and stipend payment records, is retained for 7 years from the end of your placement to meet audit and financial reporting obligations.

Partner Companies

Company account data is retained for the duration of your participation in the Programme and for 7 years thereafter to meet audit requirements.

Data Deletion

After the retention period expires, we securely delete your data. You may also request earlier deletion of your data as described under your rights.

7. Data Security

We implement enterprise-grade technical and organizational measures to protect your personal data from unauthorized access, use, or disclosure.

7.1 Security Measures

Encryption in transit (TLS) and at rest (AES-256)
Multi-factor authentication for administrative access
Security audits and penetration testing
Automated backups and disaster recovery plans

7.2 Your Responsibilities

For All Users

You are responsible for maintaining the confidentiality of your account password. Notify us immediately if you suspect unauthorized access to your account.

For Partner Companies

Company representative accounts have privileged access to shorlisted candidate data. To maintain the integrity of our audit logs and prevent data breaches, do not share login credentials and only delegate access whenever necessary.

8. Your Rights & Dispute Resolution

8.1 Your Privacy Rights

Right to Access

Request a copy of the personal data we hold about you.

Right to Correction

Request correction of inaccurate or incomplete data.

Right to Deletion

Request deletion of your data, subject to legal requirements.

Right to Restrict Processing

Request to limit how we use your data in certain circumstances.

Right to Data Portability

Receive your data in a structured, machine-readable format.

Right to Object

Object to processing based on legitimate interests.

8.2 Dispute Resolution

9. Cookies & Tracking Technologies

We use cookies and similar technologies to enhance your experience, analyze usage, and improve the Platform.

9.1 Types of Cookies We Use

Essential Cookies

Required for core Platform functionality, including authentication, security, and session management.

Analytics Cookies

Help us understand how users interact with the Platform so we can improve performance.

9.2 Managing Cookies

You can control cookies through your browser settings. Note that disabling essential cookies may prevent you from using certain Platform features. We do not use cookies for advertising purposes.

10. Changes to This Notice

We may update this Privacy notice from time to time to reflect changes in our practices, technology, or legal requirements.

10.1 Notification of Changes

When we make material changes, we will:

  • Post the updated notice on this page with a new "Effective" date
  • Send an email notification to registered users
  • Display a notice on the Platform for at least 30 days

10.2 Your Acceptance

Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Privacy Notice. If you disagree with the changes, you must stop using the Platform and may request deletion of your data.
